Miss Anyway (also distributed as "TripleB — Miss Anyway — Dart Tournament") is published by Elmaso Venture UG (haftungsbeschränkt), Matthias-Weete-Straße 8, 34479 Breuna, Germany (contact@elmaso-ventures.de).
Subject to your compliance with these Terms, Elmaso Venture UG grants you a limited, non-exclusive, non-transferable, revocable license to download and use Miss Anyway on devices that you own or control, solely for your personal, non-commercial purposes.
You may not copy, modify, distribute, sell, sublicense, or create derivative works based on the app or any part of it without our prior written consent.
You agree to use Miss Anyway only for lawful purposes and in accordance with these Terms. You may not use the app in any way that violates applicable local, national, or international laws or regulations.
Miss Anyway and all of its content, features, and functionality — including but not limited to the software, design, text, graphics, and logos — are owned by Elmaso Venture UG and are protected by German and international copyright, trademark, and other intellectual property laws.
If you downloaded Miss Anyway from Apple's App Store, Apple's standard end-user license agreement (EULA) also applies. If you downloaded from Google Play, Google Play's terms of service also apply. In the event of a conflict between those platform terms and these Terms, these Terms govern to the extent permitted by the platform provider.
Miss Anyway is provided "as is" and "as available" without any warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be error-free, uninterrupted, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Elmaso Venture UG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use Miss Anyway, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app in the twelve months preceding the claim.
We may update Miss Anyway or these Terms at any time. We will update the "Last updated" date at the top of this page when we do. Continued use of the app after any such change constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of Miss Anyway shall be subject to the exclusive jurisdiction of the courts of Kassel, Germany, to the extent permitted by applicable consumer protection law.
